Important Notes:

Due to the nature of these assets special collection conditions apply:

  • The purchaser is responsible for safe and suitable removal of each wagon(s) listed in this sale *prior to 14 February 2023.
  • A SWMS form, certificates of currency for public liability, professional indemnity, etc. will need to be provided by the purchaser and/or their contractors and approved by the vendor in advance of any works being undertaken onsite.
  • A site induction will need to be completed by all parties attending the site or undertaking works.
  • If removing by rail, the purchaser needs to apply for and receive a TOC that allows them sufficient time to meet the above removal date.
  • Bearing tests are required and Ainsworth’s have indicated they can inspect 2-3 wagons per day to be organised/paid at the expense of the interested parties.
  • If removing by road, the winning bidder must provide/ensure suitable personnel to carry out duties.
  • All items must be collected within the collection dates stated. Any items not collected after the specified collection dates for this sale will incur a $50 a day storage charge that will be payable onsite prior to releasing any goods. Any customers that have not made any resonable efforts to organise collection with in a timely manner means you give permission to the vendor to dispose of all assets at their sole discretion. As the customer you also agree to release the vendor and all associated parties, including their agents, employees and suppliers from any and all actions, suits and claims of any nature now and in the future in relation to this matter.

This Sale has a Variable Buyers Premium of 15% for items < $2,000 and 11% for items > $2,000, the Buyers Premium will be added to your final bid price.

Product Condition - Please refer to the individual lot description for product condition. Most lots have pictures assigned to them. These should be taken as a guide only. We accept the following methods of Payment:

Credit Card

  • 1% surcharge applies to Mastercard & VISA transactions
  • 2% surcharge applies to American Express & Diners Club transactions
  • No other cards are accepted
  • Invoices totalling less than $10,000 will be automatically debited from the card nominated within your account
  • Invoices totalling in excess of $10,000 can be paid in-person at any Grays office

PayPal

  • 1% surcharge applies to PayPal transactions
  • Only accepted for invoices totalling less than $10,000 where elected as your preferred payment method within your account

EFT (Direct Deposit)

  • For invoices totalling in excess of $10,000. Payment must be made in full within two business days of the auction closing.
  • Please ensure you state your invoice number within the payment reference. As EFT transfers can take up to 2 business days to clear, please contact Grays prior to collecting your purchase to confirm receipt of clear funds

Cash

  • Accepted only when deposited at an Westpac Branch
  • Please ensure you state your invoice number within the payment reference
  • When collecting an asset immediately after a cash deposit, please ensure you present the original Westpac deposit receipt
  • (We do not accept cash at any Grays or Vendor premises)

Bank Cheque

  • Accepted for invoices totalling in excess of $10,000
  • It is preferred that Bank Cheques are deposited at an Westpac Branch

Online Auction Closing

Typically, auctions are over at their posted times. There are some exceptions to this, however, if there are any successful bids on a particular lot within 10 minutes of the close of the online auction (the “Going, Going, Gone! Period), it will be extended until there are no successful bids within the "Refresh Period".

There is no limit to the number of times an online auction can be extended. This makes graysonline work more like a live auction where the bidding doesn’t stop as long as there is still interest in the product, rather than assigning an arbitrary cut-off time. This means it is a good idea to watch the action as the auction nears closing time and to check back often

  • Grays will require social distancing standards to be followed by employees and members of the public.

Grays advises all buyers that all plant offered for sale at auction may not be fit for use in a workplace.

Grays will provide:

  • Safety information relating to the condition of the item of plant for sale (Plant Hazard Reports)
  • Clear identification and marking to identify that the plant item is only suitable for scrap or spare parts
  • Site Access, PPE and Removal of Plant requirements are listed under the Inspection and Collection Headings.

Please note:

  • Persons under the age of 15 years will not be permitted onsite.
  • Tradespeople eg; electricians, plumbers etc will be required to produce the relevant licence before commencing work on site.
  • Riggers, Forklift and Crane Drivers etc will be required to produce the relevant license before commencing work on site.
  • It is a condition of entry to site that all visitors comply with any directions given by Grays (NSW) Pty Ltd staff or their representatives.
  • Work carried out on this site must be completed in a manner compliant with all Occupational Health & Safety legislation.
  • All power tools and equipment used on site must be tested (tagged) safe for use in accordance with AS3760 service testing and inspection of electrical equipment.
  • Grays (NSW) Pty Ltd will specify, based on the hazards present on the site, the mandatory personal protective equipment required to be worn prior to approval being given for entry to the site. (eg; safety footwear, safety eyewear, hard hats etc)
  • The use of certified equipment, harnesses, work platforms etc will be required for any work carried out above 1.8metres.
Enclosed footwear must be worn onsite – Safety boots may be required at industrial sites.
